1. Who we are
orto.band is operated by Ortomate Ltd (NZBN 9429052636967), a company registered in New Zealand. In these terms, “we”, “us”, and “our” refer to Ortomate Ltd. “You” means anyone who accesses or uses this site.
2. What orto.band does
You have a conversation with Muso, our AI musician, and we compose an original EP or album from what you describe. You can preview short samples, then pay to generate the full record and download it.
3. Your music and ownership
When you pay for a record, the resulting tracks are yours to keep and use, including for personal and commercial purposes. The music is generated to be original and free of third-party samples or copyrighted names. We do not claim ownership over the finished tracks composed for you.
We use AI (including Anthropic’s Claude and ElevenLabs) to plan and generate your music. AI output can contain errors or unexpected results, and we do not guarantee that any particular result will meet your expectations.
4. Audio you upload
If you upload audio for Muso to build around, you confirm that you own it or hold the rights to use it, and that using it does not infringe anyone else’s rights. You are responsible for the audio you provide. We may remove content that appears to breach these terms.
5. Sharing albums
Albums are private by default. You may choose to make an album public, which creates an unlisted link that anyone can use to view and download it. You are responsible for who you share that link with, and you can make the album private again at any time.
6. Payments
Payments are processed by Stripe. We do not see or store your card details. Under the New Zealand Consumer Guarantees Act 1993, digital content must be of acceptable quality. If your record fails to generate or is substantially defective, contact us for a replacement or refund.
7. Accounts
You sign in with Google or an email magic link. You are responsible for keeping access to your email and account secure. You can ask us to delete your account at any time by contacting us.
8. Acceptable use
You agree not to misuse orto.band, including by attempting to break its security, generate content that infringes others’ rights, or use it for unlawful purposes.
9. Intellectual property
The orto.band website design, code, brand, and the Muso character are copyright © 2026 Ortomate Ltd. All rights reserved. This does not affect your ownership of the finished tracks composed for you.
10. Availability
We aim to keep orto.band available but do not guarantee uninterrupted access. We may modify or discontinue features at any time.
11. Limitation of liability
To the maximum extent permitted by New Zealand law (including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986), our total liability to you for any claim arising from your use of orto.band is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or incidental damages. Nothing in these terms limits any rights you have under New Zealand consumer law that cannot be excluded.
12. Changes to these terms
We may update these terms from time to time. The “last updated” date at the top of this page will change when we do. Continued use of the site after changes constitutes acceptance.
13. Governing law
These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
